Welcome to Manobela (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our mobile application Manobela (“App”). By downloading, installing, or using the App, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using the App, you confirm that you have read, understood, and agree to these Terms and all operating rules, policies, and procedures that may be published from time to time by us.

2. Description of the Service

Manobela is a driver monitoring system that uses the mobile phone camera and computer vision to detect unsafe driving behaviors.

3. Eligibility

You must be at least 13 years old to use the App. If you are under the age of majority in your jurisdiction, you must have permission from a parent or guardian.

4. User Responsibilities

You agree to:

• Use the App only in a safe and lawful manner.
• Follow all local traffic laws and regulations.
• Avoid using the App in a way that distracts you from driving.
• Mount the phone safely and ensure it does not obstruct your view.
• Not rely solely on the App for safety or decision-making while driving.

5. Camera Access & Permissions

The App requires access to your device’s camera to function. You authorize the App to access and use the camera for the purpose of driver monitoring.

You may revoke camera permission at any time; however, doing so may limit or disable the App’s functionality.

6. Data Collection and Privacy

Manobela does not collect, store, or share any user data or camera footage by default.

If you enable any optional data logging, data may be stored locally on your device. We will not share this data with third parties unless explicitly stated and authorized by you.

7. Accuracy and Reliability Disclaimer

The App is designed to provide driver behavior alerts based on real-time monitoring. However:

• The App is not a medical device and is not intended for medical diagnosis.
• The App cannot guarantee detection accuracy.
• Performance may be affected by lighting, camera angle, device model, and other environmental factors.
• The App should not be relied upon as a substitute for safe driving practices.

8. Intellectual Property

All content, features, and functionality of the App, including text, graphics, logos, software, and models, are the exclusive property of Manobela or its licensors and are protected by applicable intellectual property laws.

If any part of the App is open source, it is still protected by the applicable open source license, and the App’s branding and trademarks remain proprietary.

9. No Warranty

The App is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, in no event will Manobela or its affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

• Use or inability to use the App
• Any inaccurate or unreliable results
• Any accident or injury resulting from using the App
• Any loss of data or device damage

11. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and without notice.

Upon termination, you must stop using the App and delete it from your device.

12. Third-Party Services

The App may use third-party services, libraries, or software. We are not responsible for the terms, privacy policies, or practices of any third-party providers.

13. Changes to Terms

We may modify these Terms at any time. We will post the updated Terms with a new “Last updated” date.

Your continued use of the App after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the Philippines, without regard to its conflict of law provisions.
